In an opening memory of Merck's loss during the first Vioxx trial and subsequent vow to fight (and win the majority of subsequent cases individually), Roche Holdings lost a suit to an Alabama man in a New Jersey courtroom.
Andrew McCarrell filed in New Jersey, where Roche's US operations are headquartered. His suit claimed that the company's acne medication called Accutane caused McCarrell to develop inflammatory bowel disease (IBD), a catch-all term for Crohn's Disease and ulcerative colitis. IBD is often treated with medication, although severe cases require durgs with significant side effects, pain, surgery and a significant increase in the risk of colon cancer.
McCarrell was awarded $2.5 million in punitive damages and $119,000 in expenses. Roche, basing its argument on McCarrell's diagnosis a year after he stopped taking the drug and science's inability to determine what causes IBD, announced that it plans to appeal.

The U.S. Environmental Protection Agency’s (EPA) helicopter, the “Coastal Crusader,” is tuned-up and ready for action and so is the Agency’s summer monitoring program. While the Coastal Crusader is scanning the New York and New Jersey harbor for floating debris that could make its way to area beaches, EPA scientists will be evaluating a new cutting-edge rapid water quality test that can identify harmful pathogens in a fraction of the time the traditional test takes. The Agency will analyze samples collected through the excellent monitoring programs conducted by local authorities. EPA will further support New Jersey and New York’s beach monitoring programs by providing them almost $1 million in grants to help them test for pathogens in recreational waters.
“When people go to the beach they want to have fun, relax and enjoy all the beauty that New Jersey and New York’s coastlines have to offer,” said Alan J. Steinberg, EPA Regional Administrator. “By scanning the inshore waters for floating debris, helping fund state and local beach monitoring programs, and working to put advanced scientific tools into the hands of local officials, EPA is truly doing its part to safeguard our sand and surf.”
Between Memorial Day and Labor Day, EPA uses the Coastal Crusader to search for floating debris that can wash up on area beaches. Information is given to the U.S. Army Corps of Engineers, which uses skimmer vessels to remove debris from the surface water and ensure that no floating debris is washed ashore on area beaches.
EPA also awards funds to both New Jersey and New York each year under the Beaches Environmental Assessment and Coastal Health Act (BEACH Act) to make beach monitoring programs more consistent nationwide, improve water quality testing at the beach, and help beach managers better inform the public about water quality problems. The act authorizes EPA to award grants to help eligible states, tribes, and territories develop and implement beach water quality monitoring and notification programs. This year, EPA will give New Jersey $441,955, and New York $512,965.

Approximately 2.5 million GE dishwashers have been recalled by the company and the United States Consumer Product Safety Commission. The machines can cause a fire hazard, according to the government agency, which said that GE has received 191 complaints about fires, including 12 that spread beyond the unit itself.
Brands included in the recall were sold for a four year period beginning in 1997. GE branded dishwashers are not the only ones recalled. Those branded Hotpoint or Sears Kenmore may also be impacted. Consumers should immediately stop using the recalled dishwashers and contact General Electric for a free repair, a $150 rebate towards the purchase of a new GE dishwasher, or a $300 rebate towards the purchase of a new GE Profile or GE Monogram dishwasher toll-free at (877) 607-6395 from 8 a.m. to 8 p.m. ET Monday through Saturday. A shuttered San Diego vocational school has been sued for allegedly bilking students out of millions of dollars in tuition for computer classes that were not delivered, according to a joint lawsuit by California Attorney General Edmund G. Brown Jr. and San Diego District Attorney Bonnie M. Dumanis.
“Students are saddled with enough debt going to school, and it’s outrageous that they paid for classes that were never taught,” Brown said.
“The school’s owners failed to give refunds and misled students, causing hundreds of complaints to come in to our consumer protection unit,” Dumanis said. “Thanks to the efforts by the attorney general and our office, these students will get their money back.”
The suit, which seeks millions of dollars in fines and restitution, accuses the owners and operators of MicroSkills of charging students about $25,000 in tuition and of closing the San Diego campus without refunding students. The suit accuses the owners and operators of soliciting students to enroll even as the school was going to close October 20. “Defendants continued to sign up new students and receive payments from students for such training during the time defendants intended to close their school,” said the lawsuit, filed in San Diego County Superior Court.
As many as 350 students were affected, and the suit alleges the company falsely promised refunds would be provided for any classes not provided.
“I was trying to better myself and instead this turned out to be a big downfall and now I’m in debt,” said 28-year-old student Kevin Schatte. The Spring Valley resident lost more than $21,000 in tuition.
California law requires when a private for-profit vocational school closes it must refund, within 30 days of closing, tuition for all classes that were not provided. MicroSkills and its owners failed to provide either partial or full restitution.
The lawsuit seeks a permanent injunction, restitution of tuition to as many as 350 former MicroSkills’ students of approximately $2.5 million, and civil penalties of at least $2 million.
The suit targets Firouz Memarzadeh and Farah Memarzadeh, husband and wife of La Jolla, the Memarzadeh Family Trust and others.

A listserv account used by the Washington Attorney General’s Office to send news items was hijacked as part of a “phishing” scam. State agencies have resolved the problem to ensure further unauthorized e-mails are not sent.
Subscribers received a e-mail message that appears to come from “Military Bank Online” but includes the listserv address in the “from” line. The message aims to trick readers into clicking on a link that resembles a Bank of America Web site and asks for account login information.
Do not follow the link. Do not provide any identifying information. Delete the e-mail.
These emails did not originate from the Attorney General’s Office or a bank. The perpetrators of this scam aim to prey on unsuspecting members who follow the link and then enter their account user name and password. They could become victims of identity theft and fraud. Never reply to e-mails that ask for personal information and don’t click on links in e-mails or pop-ups. Legitimate financial institutions will never ask you to verify your identity online.
If you have responded to this fraudulent e-mail, your financial and personal information could be compromised.
• Please contact your bank immediately to protect your account.
• Carefully check credit card and bank statements for unauthorized charges each month.

Two US Senators, Carl Levin (D-MI) and Claire McCaskill (D-MO) have introduced a bill that will help protect consumers against aggressive credit card practices. Especially targeted in the proposed legislation is the ability to raise rates on one account if an account at another entity is paid late.
"Lenders have a legitimate concern if someone is not properly managing their credit, but once credit is granted, that concern needs to be limited to the consumer's relationship with the lender, not continually re-evaluated," said Consumer Help Web President Joan Bounacos. "Making a late payment on a single credit card is not good, but should not cause other lenders to automatically raise rates. That's a poor excuse to take advantage of a consumer who is already having trouble."
Multiple consumer advocates endorsed the legislation, known as "The Stop Unfair Practices in Credit Cards Act". The bill's other protections are also consumer friendly:
Interest Rates
* No Interest on Debt Paid on Time. Prohibit interest charges on any portion of a credit card debt which the card holder paid on time during a grace period.
* No Trailing Interest. Prohibit added interest charges on credit card debt which the card holder paid on time and in full.
* Limits on Penalty Interest. Prohibit interest rate hikes on a credit card account unless the card holder agrees to them at the time, and in any event, limit penalty interest rate hikes to no more than a 7% increase.
* Apply Interest Rate Increases Only to Future Debt. Require increased interest rates to apply only to future credit card debt, and not to debt incurred prior to the increase.
Credit Card Fees
* No Interest on Fees. Prohibit the charging of interest on credit card transaction fees, such as late fees and over-the-limit fees.
* Restrictions on Over-Limit Fees. Prohibit the charging of repeated over-limit fees for a single instance of exceeding a credit card limit, and allow such fees to be charged only when a card holder’s action, rather than a penalty, causes the limit to be exceeded.
* No Pay-to-Pay Fees. Prohibit charging a fee to allow a credit card holder to make a payment on a credit card debt, whether payment is by mail, telephone, electronic transfer, or otherwise.
* Reasonable Currency Exchange Fees. Require currency exchange fees to reasonably reflect the credit card issuer’s actual costs.
Other Protections
* Prompt and Fair Crediting of Card Holder Payments. Require consumer payments to be applied first to the credit card balance with the highest rate of interest, and to minimize finance charges. Prohibit late fees if the card issuer’s action caused the delay in crediting a payment.
* Fixed Credit Limits. Require that card issuers must offer consumers the option of having a fixed credit limit that cannot be exceeded.
“Credit card issuers too often sock consumers with sky-high interest rates and excessive fees, making it harder and harder for families to climb out of debt,” Levin said. “The goal of this legislation is to put an end to unfair and abusive credit card practices that outrage so many American families. I’m afraid these practices have become too entrenched and too profitable to the credit card companies for the companies to change them on their own. Congress needs to enact pro-consumer legislation to put an end to these unfair practices.”

Following in the Attorney General crusading footsteps of now-governor Eliot Spitzer, New York Attorney General Andrew Cuomo filed suit against Dell Computer yesterday.
The suit alleges that Dell and its financial subsidiary engage in "fraud, false advertising and deceptive business practices". To be fair to Cuomo's and his office, no press release was issued and few, if any, quotes are being released.
The suit, filed in a state court in Albany, not only seeks damages for consumers, but a $25,000 payment to New York for each incident and other costs.
Dell has been rocked hard lately and is also undergoing an unrelated SEC investigation.

Sending Uncle Frank a card for his birthday? You better make sure you have the correct postage. On May 14, 2007, a First-Class Mail stamp will increase to 41 cents, along with several other changes, including:
* First-Class postage for postcards will now be 26 cents.
* International mail products have now been simplified from eight main products into four: Global Express Guaranteed, Express Mail International, Priority Mail International and First-Class Mail International.
* Customers can use the same Priority Mail and Express Mail packaging whether they are shipping within the United States or to another country.
In addition to these changes, the U.S. Postal Service (USPS) is issuing the Forever Stamp, which should get rid of the hassle of having to buy “make-up” stamps (1-cent and 2-cent stamps) whenever a price increase occurs. The Forever Stamp will initially be sold at the new First-Class stamp rate of 41 cents, but its value will always be the First-Class mail rate that is in effect on the day that the stamp is mailed. The Forever Stamp will be unaffected by any price increases in the future—that means forever, according to the USPS.

The company worked with the federal government on Thursday to voluntarily recall 450,000 of these seats after receiving reports of more than 670 malfunctions. Those errors caused 160 injuries to children, including one child with a fractured skull.
The company reports that the handle can "unexpectedly release" and cause your child to fall forward. The recall involves Evenflo Embrace™ Infant Car Seat/Carriers made before April 8, 2006. Allstate, a $40 billion company that has a P/E ratio of less than 8, demonstrated today how it keeps it financials looking so healthy.
The giant insurer announced that it would no longer write new homeowners policies in the entire state of California, effective July 1. Given that California is by far the nation's largest state, one knows the decision wasn't taken lightly, but cutting off the state is a drastic step.
Allstate, which insures nearly 20 million homes, had already taken similar action in hurricane haven Florida, as well as several other states where loss data or legal and regulatory issues made a compelling business case.
The company is free, of course, to sell its products where it likes, but one wonders how the Allstate agency owners in California are feeling this Friday morning. Sure, there are cars and life and all sorts of other insurance products to sell, but the company just cut off several tens of millions of people from using its homeowner product in the future.
They won't be in good hands. They'll be in someone else's hands

The University of Missouri and law enforcement are investigating a recent attack on a database by an unknown computer hacker or hackers that allowed retrieval of names and Social Security numbers of 22,396 individuals associated with the University. Those affected were employees of any campus within the UM System during calendar year 2004 who were also current or former students at the Columbia campus.
The University's Information Technology staff first noted unusual activity on a computer application last Thursday, May 3. On Friday morning, May 4, UM technicians identified a large series of errors caused by faulty queries to the application and an associated database. These errors were first assumed to be caused by a problem with a system used to track computer help desk repair calls using the same database. The attack was confirmed by UM technicians that same day. They disabled the account that was being used by two overseas IP addresses to access the database from China and Australia.
The University is alerting individuals whose information was disclosed that they should request a free initial fraud alert to be placed on their credit files by calling any one of the three national credit reporting agencies – Equifax, Experian or TransUnion.
The University has also set up a telephone hotline and a Web page to provide more information. The hotline may be called between 8 a.m. and 5 p.m., Monday through Friday. The toll-free number is 866-241-5619, and the local number in Columbia is 573-884-7222.

The first shipments of irradiated Indian mangoes have arrived through U.S. ports-of-entry, initiating mango trade with the United States.
Indian mangoes are the first fruit irradiated at an overseas site and approved for importation into the United States. Irradiation became an approved treatment on all pests for fruits and vegetables entering the United States in 2002. Last year, a generic dose was recognized for a wider range of commodities, including Indian mangoes. The use of irradiation provides an alternative to other pest control methods, such as fumigation, cold and heat treatments.
"This is a significant milestone that paves the way for the future use of irradiation technology to protect against the introduction of plant pests," said Secretary Mike Johanns. "India and the United States began talking about shipping mangoes 17 years ago. Irradiating Indian mangoes safeguards American agriculture while providing additional choices for U.S. consumers in today's global marketplace."
APHIS, the Animal Plant Health Inspection Service, approved the importation of precleared, commercial shipments of fresh mangoes from India, provided certain conditions are met. To ensure that plant pests of quarantine significance do not enter the United States though the importation of this fruit, the mangoes must be treated with specified doses of irradiation prior to export at an APHIS-certified facility. Each shipment must also be accompanied by a certificate issued by the national plant protection organization of India with additional declarations certifying that the treatment and inspection of the mangoes was made in accordance with APHIS regulations. In addition, inspectors with the Department of Homeland Security's Customs and Border Protection may further inspect precleared commodities at the port of first arrival.

Medicis Pharmaceutical Corporation of Scottsdale, Ariz., will pay the United States $9.8 million to settle allegations that the company violated the False Claims Act with respect to claims submitted to Medicaid, the Justice Department announced today. The settlement resolves allegations that Medicis promoted the use of a topical skin preparation, Loprox, for use on children under the age of 10, without approval by the Food & Drug Administration (FDA).
The United States and the whistleblowers – former Medicis employees – alleged that from approximately November 2001 through April 2004, Medicis sales personnel targeted pediatricians, urging the doctors to use Loprox as a treatment for diaper rash. The use of Loprox, which is approved by FDA as a fungicide for patients over 10 years of age, is not a “medically accepted indication” for the treatment of diaper dermatitis and other skin disorders in children under 10.
“This settlement demonstrates our ongoing commitment to protecting funds for federal health care programs,” said Assistant Attorney General Peter D. Keisler. “Pharmaceutical companies need to know that they will be held accountable for off-label marketing schemes and other illegal activities that affect those programs.”
The Food, Drug & Cosmetic Act prohibits pharmaceutical companies from marketing or promoting a drug for uses that the FDA has not approved, a practice known as “off-label marketing.” In the case against Medicis, the United States alleged that the Medicaid program paid millions of dollars for Loprox prescriptions that would not have been reimbursed if government authorities had known that the prescriptions resulted from the company’s off-label marketing campaign.
Medicis sold its pediatric sales unit in 2004.
The civil settlement resolves claims brought by four former Medicis sales representatives. As a result of the settlement, the whistleblowers will collectively receive in excess of $1,078,000 as their statutory award. Under the qui tam provisions of the False Claims Act, private parties can file an action on behalf of the United States and receive a portion of the settlement if the government reaches a monetary agreement with the defendants.

The nation’s largest airlines recorded a rate of on-time flights this past March that was higher than in February but down from the rate posted in March 2006, according to the Air Travel Consumer Report released by the U.S. Department of Transportation (DOT).
The 20 carriers reporting on-time performance recorded an overall on-time arrival rate of 73.3 percent in March, down from March 2006’s 76.1 but an improvement over February 2007’s 67.3 percent.
Special jeers for U.S. Airways. According to the government agency, the airline had by far the lowest on-time rate at 55.5% (JetBlue was next with 63% -- that's a huge difference). Even more astonishing was the performance of several US Airways flight. The survey found that one flight between Washington, D.C.'s Reagan National Airport to New York -- a flight with direct competition from Delta's "shuttle" was late 100% of the time. That's right, every single flight. Here are the worst five flights and the top 3 overall performing airlines:

Industry experts estimate that as many as one out of 25 previously damaged vehicles may have non-functional air bags. Con men purposely replace deployed air bags with anything from packing peanuts to stolen units. This growing scam is threatening the lives of used car buyers everywhere. To help consumers protect themselves, Carfax now makes the air bag deployment information in its database available for free.
“No question, air bags are a lifesaver,” said Larry Gamache, communications director at Carfax. “To best protect yourself, follow these two important steps: Use the free Carfax air bag check and always have your mechanic test the air bag system to ensure it’s functioning properly before you buy. Do not assume your car’s air bags will deploy when you need them, because most victims of this scam may never know until it’s too late.”
According to the National Highway Transportation Safety Administration, nearly 20,000 lives have been saved by air bags deploying in an accident. As the height of used car buying season quickly approaches, consumers need to be on the lookout for scams like air bag fraud that can threaten their safety.
“While we don’t know about every air bag deployment, we want consumers to have access to what we do know,” added Gamache. “We also encourage all of our customers who have information about a previous air bag deployment not currently in our database to tell us so we can further help consumers steer clear of this scam.”

Florida Agriculture and Consumer Services Commissioner Charles H. Bronson is urging consumers to check their refrigerators for Ole Mexican Foods’ Verole Queso Fresco Authentic Mexican Crumbling Cheese and Ole Fresco Authentic Mexican Crumbling Cheese. The two products may be contaminated with E. coli bacteria.
The potential for this contamination was determined after random testing performed by the Florida Department of Agriculture and Consumer Services revealed the presence of E.coli bacteria in samples of both of the cheeses.
“The discovery of this problem demonstrates the importance of an integrated pro-active food safety program, where products from stores and food processors are not only inspected but tested in our labs, as well,” Bronson said.
Department inspectors are working with Florida grocery chains to remove any of the potentially tainted cheese from those stores and are checking warehouses in Florida from which the products were distributed. Bronson said his agency has also notified the U.S. Food Drug Administration, which is responsible for the products in other states.

Menu Foods has previously recalled wet cat and dog food produced with adulterated wheat gluten supplied by ChemNutra Inc. Menu Foods is now expanding the recall to include cuts and gravy and select other products which do not include ChemNutra wheat gluten but which were manufactured at any of Menu Foods’ plants during the period that ChemNutra wheat gluten was used at that plant, to the extent they have not already been subject to a recall, due to the possibility of cross-contamination. Menu Foods has received a report from a customer and has received study results, both of which indicate cross-contamination.
As a result, Menu advises the public:
* Additional items in the United States and Canada have been added to the recall list as shown below. A further two varieties for Europe have been added to the recall list.
* The recall dates of those products previously recalled have been modified to include all dates during the period that ChemNutra wheat gluten was used in the applicable Menu plant.
